INFORMATION ON THE PROCESSING OF PERSONAL DATA

The personal data transmitted by the users of the website www.archigo.it (hereinafter, “website”) when filling in forms, orders, questionnaires, requests or by sending e-mail messages (hereinafter, “Personal Data”) will be acquired and processed by VIASOLFERINO HOME RAGUSA SRL (hereafter, “Archigo”) with head office in Ispica, C.da GARZALLA s/n, CAP 97014 Ispica (Ragusa), C.F./P.IVA 01610670885, registered at the REA of Ragusa n. 108296, in the person of the person responsible to treat the data. The processing of Personal Data carried out by Archigo shall be carried out in compliance with Legislative Decree No. 196/2003 and subsequent amendments concerning the protection of personal data (“Privacy Code”).

1- Information on the processing of Personal Data

Personal Data shall be processed by Archigo for purposes directly connected with and instrumental to the activation and operation of the services provided, for the fulfilment of the obligations provided for by law, by a regulation or by the European Community legislation, for the exercise of one’s rights in a court of law, for the user’s registration on the site, for sending the newsletter on sales campaigns and other periodical communications relating to the services offered, for executing and managing the sales contract possibly concluded with the customer and for the fulfilments, of a legal or fiscal and accounting nature, connected thereto.

The provision of Personal Data is optional; however, failing to provide certain Personal Data prevents Archigo from providing the requested services or concluding the contract. The processing of Personal Data is carried out by the persons in charge of the processing, using manual, electronic and telematics tools, suitable to guarantee security and confidentiality. We will store the Personal Data both on computer media and, where necessary, on paper media. We will also record them on the database owned by Viasolferino Home Ragusa S.r.l. and made accessible only to persons working within the company.

The Personal Data may also be communicated to the persons in charge of logistics, shipping, delivery and return of the purchased products; to the banks, for the management of receipts and payments; to consultants and collaborators appointed by Archigo to provide (for example) assistance in fiscal, accounting and legal matters, it being understood that these subjects will not communicate the users’ data to third parties; to entities that provide services for the management of Archigo’s information system and telecommunication networks; to entities that perform control, audit and certification of the activities carried out by Archigo also in the interest of its customers.

If Archigo acts as an intermediary, the Personal Data required will be communicated to the Supplier who will process it under its privacy policy and will be solely responsible for the processing so carried out.

2- Consent

By accepting this notice, the user accepts this privacy policy and allows Archigo to process the Personal Data thus acquired under the purposes and methods indicated.

The user may give his/her consent to receive advertisements for Archigo’s products, at the e-mail address indicated at the time of registration and purchase, communications and commercial proposals relating to and/or connected with Archigo’s services in the form provided during registration.

The user may subsequently object to receiving the aforementioned advertising material by sending an e-mail to privacy@archigo.it.

 

3- Right of access, rectification, cancellation and opposition

The user may obtain, at any time, confirmation of the existence of the data concerning him/her and the purposes for which they are used. He or she may also request that the data be updated or corrected, cancelled or blocked, and to object, in whole or in part, to the processing of the data as provided for by the applicable legislation, and in particular by Archigo in article 7 of Legislative Decree No. 196/2003 and subsequent amendments.

Archigo also allows the Data Subject the right to obtain the erasure of his/her Personal Data. In this case, Archigo may still keep some of your Personal Data in order to fulfil or comply with any legal and fiscal obligations.

Article 7. of Legislative Decree 196/2003 provides: “Right of access to personal data and other rights”.

1. The interested party has the right to obtain confirmation of the existence or not of personal data concerning him, even if not yet recorded, and their communication in intelligible form.

2. The data subject shall have the right to be informed about

(a) the origin of the personal data;

b) the purposes and methods of processing

c) the logic applied in the event of processing carried out with the aid of electronic instruments;

d) the identity of the data controller, data processors and the representative designated under Article 5(2);

e) the entities or categories of entity to whom or which the personal data may be communicated and who or which may get to know said data in their capacity as designated representative(s) in the State’s territory, data processor(s) or person(s) in charge of the processing.

3. The interested party has the right to obtain

a) the updating, rectification or, when interested, integrating data;

b) the cancellation, transformation into anonymous form or blocking of data processed in breach of the law, including data whose retention is unnecessary for the purposes for which the data were collected or subsequently processed;

c) certification to the effect that the operations as per letters a) and b) have been notified, as also related to their contents, to the entities to whom or which the data were communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected.

4. The interested party has the right to oppose, in whole or in part

(a) on legitimate grounds, to the processing of personal data concerning him/her, other than that relevant to the purpose of collection;

b) to the processing of personal data concerning him/her, where it is carried out to send advertising materials or direct selling or else for performing market or commercial communication surveys.

 

4- Content of Personal Data

The data subject handles the accuracy of the Personal Data communicated or transmitted. Archigo assumes that the Personal Data has been communicated by the interested party or by a person authorised by him/her.

5- Processing methods

The data is collected electronically and processed by registration, consultation, communication, storage and deletion operations, carried out mainly with the aid of electronic instruments, ensuring the use of measures for the security of the data processed and guaranteeing its confidentiality.

The personal data will be processed by collaborators and/or employees of the Data Controller as data processors or persons in charge of the processing, within their respective functions and in compliance with the instructions given by the Data Controller.

Archigo guarantees the highest level of security in the management of user data.

Under art. 12 of Legislative Decree 70/2003 and subsequent amendments, each order is stored in digital form / paper on the server / at the headquarters of Viasolferino Home Ragusa S.r.l., according to criteria of confidentiality and security.

 

6- Security of Personal Data

Under the applicable legislation on data protection, Archigo has taken appropriate measures to guarantee the security and confidentiality of the Personal Data provided by users and has also installed all means and measures available to prevent the loss, manipulation, alteration, unauthorised access and theft of the same.

This Privacy Policy and the terms of service are regularly reviewed and updated. Updates to this Privacy Policy are published on the website www.archigo.it. The changes are valid from the moment they are published on the website.

We therefore recommended that the user consult the website regularly to check for any updates.

 

7- Duration of processing

Processing shall not last longer than is necessary for the purposes for which the data were collected in compliance with civil, tax and fiscal obligations in force.
